Registration

Registration for training, courses, seminars and workshops is done in writing, by fax, online via the Internet or by email with the Academy of Fine Art GmbH. When registering online, the student declares a binding registration for the event by clicking the “send” button. Confirmation of receipt of the registration is sent by automated email immediately after the registration is sent and does not constitute acceptance of the contract. The contract is concluded upon receipt of the booking confirmation. Registrations are considered in the order in which they are received. Special admission or selection criteria for certain measures remain unaffected. If the number of registrations exceeds the space capacity of a course, the Academy of Fine Art GmbH reserves the right to conduct an admissions procedure. If a registration cannot be considered, the Academy of Fine Art GmbH will inform the registered person of this.

 

Prices and Payment Conditions

Unless otherwise agreed in individual cases, the prices valid at the time the contract is concluded apply. The prices stated do not include materials. The prices stated are non-binding and subject to price changes and errors.
After the first registration for the course and after each registration for events in a trimester, an invoice for the fee for the respective trimester is sent to the student. 10% of the fee for the respective trimester (processing fee) must be paid within two weeks of registration at the latest, stating the invoice number. The remaining 90% of the fee for the respective trimester must be paid no later than four weeks before the start of the trimester. If the student fails to register within the eight-week registration period before the start of the trimester, the entire fee for the respective trimester must be paid within two weeks of registration at the latest.
The respective invoice amount can be paid in equal monthly installments by separate agreement. The prerequisite is the conclusion of a written installment payment agreement.
If payment is not made on time, the Academy of Fine Art GmbH reserves the right to allocate the event space to someone else.

 

Resignation

The student can withdraw from the contract up to 4 weeks before the start of a trimester without giving reasons. The withdrawal must be declared in writing. The timeliness of the withdrawal is determined by the receipt of the declaration of withdrawal by the Academy of Fine Art GmbH. If the entire fee for the upcoming trimester has already been paid, 90% of this will be refunded, 10% of the fee for the respective trimester (processing fee) will be retained. In any case, the 10% of the fee for the respective trimester (processing fee) that must be paid within 2 weeks of registration will not be refunded.
In any case, a refund of the fee is excluded if the withdrawal period according to 3. a) is not/cannot be observed.
The “Appendix” provides information on additional provisions regarding a consumer’s right of withdrawal.

 

Study Conditions

At the beginning of the trimester, students are given a set of rules that describe the behavior and guidelines for everyday life at the Academy. Students accept these rules when they begin their training.
All students must adhere to the rules during their stay at the Academy of Fine Art GmbH, otherwise the right is reserved to exclude students from classes. Training and workshop participants must arrive on time for the start of classes. If they arrive late, students may have to wait until the break. This is especially the case for nude classes with models. In general, students are asked to behave considerately and quietly in the training rooms so as not to disturb other students and workshop participants. The consumption of alcohol or drugs is not permitted. The Academy of Fine Art GmbH is a smoke-free facility. Smokers can smoke in designated areas outside the building and are responsible for keeping the premises clean and free of cigarettes. The electronic devices in the kitchen must be kept clean and well maintained at all times. This applies in particular to the fully automatic coffee machine. Students who use it must ensure that coffee beans, milk and sugar are available. Respectful interaction is expected for a positive atmosphere. Suggestions, messages or criticism should be discussed with the responsible teacher or with the management of the Academy of Fine Art GmbH.
The Academy of Fine Art GmbH has the right to postpone or cancel events for reasons beyond its control. Students will be informed of this in good time.
During the courses and events, photos and, if necessary, videos are taken, which the Academy of Fine Art GmbH uses for advertising and documentation purposes. By registering, students and workshop participants agree to the use of the images in which they appear. If this is not desired, the student must notify us in writing. All intellectual property rights to materials available in training or workshops are held by the Academy of Fine Art GmbH. Copying these in whole or in part is strictly prohibited and will be prosecuted in the event of a violation. Photos and videos taken by students themselves on our premises may not be published or used in any other way without the prior written permission of the Academy of Fine Art GmbH. Working documents and computer software used are protected by copyright. Copying or passing on to third parties is only permitted with the prior consent of the copyright holder.
The Academy of Fine Art GmbH is liable for damages, regardless of the legal basis and whether known or unknown, in the event of intent and gross negligence. In the event of simple negligence, the Academy of Fine Art GmbH is only liable for damages resulting from injury to life, body or health or for damages resulting from the not insignificant breach of an essential contractual obligation; in this case, however, the liability of the Academy of Fine Art GmbH is limited to compensation for foreseeable, typically occurring damage.
The Academy of Fine Art GmbH is entitled to exclude students from further participation in special cases, for example late payment, disruption of the event and operational processes, non-compliance with the house rules, etc.
The student’s data will be stored and used by the Academy of Fine Art GmbH exclusively for the purpose of organizing the event.
Any subsidiary agreements must be in writing to be valid. Should individual clauses of these terms and conditions be invalid, the validity of the remaining clauses shall remain unaffected.
Unless otherwise stated, the courses take place in the premises of the Academy of Fine Art GmbH, Im Atzelnest 3, 61352 Bad Homburg von der Höhe. The law of the Federal Republic of Germany applies to all legal relationships between the Academy of Fine Art GmbH and the students.

 

Right of Withdrawal

Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the date of conclusion of the contract. To exercise your right of withdrawal, you must inform us (Academy of Fine Art GmbH, Im Atzelnest 3, 61352 Bad Homburg von der Höhe, fax: 06172/9451101, email: info@academy-malen-zeichnen.de) by means of a clear declaration (e.g. a letter sent by post, fax or email) of your decision to withdraw from this contract. To meet the withdrawal deadline, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of revocation
If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), promptly and at the latest within 14 days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will we charge you any fees for this refund. If you have requested that the services begin during the cancellation period, you must pay us an appropriate amount that corresponds to the proportion of the services already provided up to the point at which you notify us of the exercise of the right of cancellation with regard to this contract compared to the total scope of the service foreseen in the contract.

 

Attachment

If you register for our events as a consumer within the meaning of Section 13 of the German Civil Code (BGB), you have a right of withdrawal in addition to our general terms and conditions. A consumer within the meaning of the law is any natural person who concludes a legal transaction for a purpose that cannot be attributed to either their commercial or their independent professional activity.
